일제강점기 강제동원 등으로 러시아 사할린에 이주한 사할린동포가 자녀 모두와 함께 고국에 영주귀국할 길이 열렸다. 재외동포청은 사할린동포의 영주귀국 대상이 ‘직계비속 1명’에서 ‘자녀’로 확대된다는 내용 등의 ‘사할린동포 지원에 관한 특별법’(이하 사할린동포법) 일부개정법률안이 1월 16일 공포됐다고 밝혔다. 개정법률안은 공포일로부터 6개월 뒤인 7월 17일부터 발효된다.

재외동포청은 사할린동포법 시행령 등 하위법령 개정 등 준비 작업을 마친 후 2025년부터 자녀 전체로 동반 가족의 범위를 확대해 사할린동포 영주귀국 및 정착 지원 사업을 추진한다. 올해 영주귀국 사업은 개정법률안 발효 전인 6월 30일까지 현행 시행령에 따라 지원자를 신청받는다.

사할린동포법은 사할린에 이주한 사할린동포에 대해 관련 국가와의 외교적 노력으로 그 피해를 구제하고, 사할린동포와 그 동반 가족의 영주귀국과 정착을 지원하기 위해 지난 2020년 5월 제정됐다.

재외동포청 “재외동포들에게 체감할 도움 주는 데 최선”

   이 법에 따라 영주귀국 및 정착 지원 대상자로 선정된 사할린동포와 그 동반가족은 우리 정부로부터 ▲귀국에 필요한 운임 및 초기 정착비 ▲거주 및 생활 시설에 대한 운영비 ▲임대주택 등의 지원 등을 받아 고국에 정착해 왔다.

  다만, 사할린동포와 함께 영주귀국을 할 수 있는 동반가족은 ‘배우자와 직계비속 1명 및 그 배우자’로 한정됐었다. 이에 따라 자녀가 여러 명인 동포는 러시아에 나머지 자녀를 두고 영주 귀국하는 등 또 다른 이산의 아픔을 겪어야만 했다.

  개정법률안의 시행으로 사할린동포 1세 부모·자녀, 사할린동포 2세 형제·자매가 떨어져 살지 않고 귀국해 한국에서 함께 살아갈 수 있게 됐다.

  개정법률안은 이 밖에도 ▲영주귀국 동포 및 동반가족의 실태조사 의무화 ▲지방자치단체의 사할린동포 지원 근거 마련을 위한 조항도 신설해 더욱 실효성 있는 지원을 뒷받침하게 했다.

  재외동포청 아주러시아동포과 정선호 과장은 “사할린동포 사회의 숙원이었던 사할린동포법이 공포된 만큼, 재외동포청은 앞으로도 국가가 재외동포들의 곁에 있음을 체감할 수 있도록 실질적 도움을 드리는 데 최선을 다할 것”이라고 말했다.

A way has been opened for Sakhalin compatriots who immigrated to Sakhalin, Russia, due to forced mobilization during the Japanese colonial period to permanently return to their homeland with all their children. The Overseas Koreans Agency announced Jan. 16 that a partial amendment to the Special Act on Support for Sakhalin Compatriots (hereinafter referred to as the Sakhalin Compatriots Act) was promulgated on Jan. 16, including the provision that the target for the permanent return of Sakhalin compatriots to Korea will be expanded from “one direct descendant” to “children.” The amendment will take effect July 17, six months after the promulgation.

After completing preparations, such as revising the Enforcement Decree of the Sakhalin Compatriots Act and other subordinate laws, the OKA will expand the scope of accompanying family members to all children in 2025 and promote the project to support the permanent return and settlement of Sakhalin compatriots. This year’s permanent return project will accept applications in accordance with the current enforcement ordinance until June 30, before the amendment takes effect.

The Sakhalin Compatriots Act was enacted through diplomatic efforts with relevant countries in May 2020 to provide relief for the damage suffered by compatriots who immigrated to Sakhalin and to support the permanent return and settlement of Sakhalin compatriots and their accompanying families.

‘We will try our best to provide practical help to overseas Koreans’: OKA

   Sakhalin compatriots and their accompanying families who were eligible for permanent return and settlement support in accordance with this amendment have received support from the Korean government, including ▲fares and initial settlement costs required for their return to the country, ▲ operating expenses for residential and living facilities, and ▲rental housing to settle in Korea.

  However, family members who could permanently return to Korea with Sakhalin compatriots were limited to “a spouse, one direct descendant, and their spouse.” Accordingly, compatriots with multiple children had to go through a painful separation, such as leaving their children in Russia and returning permanently to Korea.

  With the implementation of the amendment, parents and children of firstgeneration Sakhalin compatriots and brothers and sisters of second-generation Sakhalin compatriots will be able to return to Korea and live together instead of being separated.

  In addition, the amendment also established new provisions to ▲mandate a fact-finding survey of compatriots returning permanently to the country and their accompanying families and ▲establish a basis for local governments to support Sakhalin compatriots, thereby providing more effective support.

  “As the Sakhalin Compatriots Act has been promulgated, which has been the long-awaited wish of the Sakhalin community, the OKA will continue to do its best to provide practical assistance so that overseas Koreans can feel that the government is by their side,” said Jeong Seon-ho, manager of the Russian Compatriots Overseas Division at the OKA.
