미국 버지니아주 역사상 처음으로 한인이 연방 지방법원 판사에 올랐다. 동포사회에 따르면, 미국 연방상원은 최근 본회의를 열고 버지니아 동부 연방지방법원 판사로 지명된 한인 1.5세 재스민 윤 (한국명 윤혜정·44) 변호사를 인준했다.

바이든 대통령은 마크 워너, 팀 케인 연방 상원의 원의 추천을 받아 지난 1월 윤 변호사를 연방지방법원 판사로 지명한다고 발표했고 이어 상원이 2개월 만에 인준한 것이다.

워너 의원과 케인 의원은 인준안 통과 직후 보도자 료를 내고“버지니아주 첫 아시아계 미국인 연방 판사인 재스민 윤은 놀라운 실력을 갖췄고, 공직에 대한 깊은 헌신이 있다”며“연방 사법부에 큰 자산이될 거라고 확신한다”고 말했다.

윤 판사는 마이클 어밴스키 수석 판사가 퇴임하면 오는 7월부터 임기를 시작한다. 울산 출신의 윤 판사는 14살 때 가족과 함께 미국 메릴랜드주로 이민했 다. 그는 버지니아대 법대와 로스쿨을 졸업한 뒤 로펌에서 변호사로 활동했다. 이민자 및 성폭력·가정폭력 피해자를 위한 무료 변론과 통역 봉사 등에 적극적으로 나서기도 해 로펌에서 ‘올해의 무료 변론 변호사상’ 을 받았다. 이후 버지니아 연방 동부 지방검찰청에서 6년 동안 검사로 일하면서 80여건의 금융 범죄 및 공직 부패 사건을 조사해 기소했다.

2019년부터는 3년간 버지니아대에서 법률 자문으로 활동했고, 2022년부터 최근 까지 금융 서비스 기업 ‘캐피털 원 파이낸셜 코퍼레이션’에서 기업 윤리 및 조사 담당 부사장으로 일했다. 그의 남편 크리스토퍼 캐버노 씨는 버지니아 연방 서부 지방검찰청에서 검사로 일하고 있다.

윤 판사는 앞서 미국 상원 법사위원회에 제출한 서면 답변서를 통해 연방 판사로 임명된다면 이해충돌 등의 문제가 발생하지 않게 업무를 수행하겠다는 의지를 밝히기도 했다.

For the first time in the history of the U.S. state of Virginia, a Korean has become a federal district court judge. The U.S. Senate recently met in a plenary session to confirm Jasmine Yoon (Korean name: Yoon Hyejung, age 44), a 1.5-generation Korean American, to serve as a judge for the U.S. District Court for the Eastern District of Virginia, according to the Korean American Society.

President Biden announced Yoon’s nomination in January after receiving the recommendations of U.S. Sens. Mark Warner and Tim Kaine, and the Senate confirmed her two months later.

“As Virginia’s first Asian American federal judge, Jasmine Yoon has remarkable skills and a deep commitment to public service, and we are confident she will be a great asset to the federal judiciary,” Warner and Kaine said in a press release shortly after the confirmation vote.

Judge Yoon will begin her term in July, when Chief Judge Michael Urbanski retires. A native of Ulsan, South Korea, Judge Yoon immigrated to Maryland with her family when she was 14 years old. She graduated from the University of Virginia and its School of Law and practiced law at a law firm.

She received the firm’s Pro Bono Attorney of the Year award for her pro bono work on behalf of immigrants and victims of sexual assault and domestic violence. She then spent six years as a prosecutor in the U.S. Attorney’s Office for the Eastern District of Virginia, where she investigated and prosecuted more than 80 financial crimes and public corruption cases.

She served as general counsel at the University of Virginia for three years, beginning in 2019, and from 2022 until most recently, she was vice president of business ethics and investigations at Capital One Financial Corp., a financial services company. Her husband, Christopher Kavanaugh, is a prosecutor in the U.S. Attorney’s Office for the Western District of Virginia.

In a written response to the U.S. Senate Judiciary Committee, Yoon previously stated that if she were confirmed as a federal judge, she would conduct her business in a manner that would not create conflicts of interest.
